End-User License Agreement (EULA) - Storyflix

PLEASE READ THIS END-USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE USING THE STORYFLIX APP ("APP"). BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS EULA AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT USE THE APP.
License Grant
Subject to your compliance with the terms and conditions of this EULA, Storyflix ("Company") grants you a limited, non-exclusive, non-transferable, revocable license to use the Storyflix app for your personal, non-commercial use on a compatible device that you own or control. This license does not entitle you to any ownership or intellectual property rights in the app.
Restrictions on Use
You shall not, and shall not permit others to:
2.1. Copy, modify, or create derivative works of the app;
2.2. Reverse engineer, decompile, or disassemble the app, except to the extent that such restriction is expressly prohibited by applicable law;
2.3. Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the app;
2.4. Use the app in any manner that violates any applicable law or regulation;
2.5. Use the app to infringe upon the rights of any third party, including but not limited to intellectual property rights and privacy rights;
2.6. Distribute, sublicense, or make the app available over a network where it could be used by multiple devices at the same time;
2.7. Use the app in any way that could disable, overburden, or impair the functionality of the app or interfere with other users' access to or use of the app;
2.8. Use any automated system, including but not limited to bots or crawlers, to access or collect information from the app;
2.9. Use the app for any commercial purpose without the prior written consent of the Company.
Content
3.1. The app may allow you to access and read books, stories, articles, or other textual content ("Content"). The Content may be provided by third-party authors, publishers, or aggregators, and the Company does not guarantee the accuracy, quality, or availability of such Content.
3.2. You understand and acknowledge that the Content may be subject to copyright and other intellectual property rights. You agree to abide by all applicable copyright laws and not to reproduce, distribute, modify, or create derivative works of the Content without the express permission of the respective copyright owners.
3.3. The Company reserves the right to remove or disable access to any Content that violates applicable laws, infringes upon the rights of others, or violates the terms of this EULA.
Privacy
4.1. The app may collect and process personal information as described in the Privacy Policy. By using the app, you consent to the collection, storage, and use of your personal information as outlined in the Privacy Policy.
Termination
This EULA is effective until terminated by you or the Company. You may terminate this EULA by deleting the app from your device and ceasing all use of the app. The Company may terminate this EULA at any time without notice if you fail to comply with any provision of this EULA.
Disclaimer of Warranty
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APP, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of [Insert Jurisdiction]. Any dispute arising out of or in connection with this EULA shall be submitted to the exclusive jurisdiction of the courts of [Insert Jurisdiction].
Entire Agreement
